Family dispute resolution

CFL Solutions seeks to work with parties and those they trust, to achieve an outcome that reflects the unique needs of each family situation. The focus is on the best interests of children, but working with the wisdom of parents about their needs and those of their children, and the support they are receiving from other professionals and those close to them.

The FDR Process

Each family situation is different, and requires a different approach in FDR.

This will include

Intake session

Each party will be interviewed for about an hour to clearly explain the FDR process and answer any questions about FDR, to gather background information and undertake an assessment as to the suitability of FDR and any special needs. This can occur in person or over the phone or by any other social media.

Settlement conference

This is an opportunity for the parties to come together to commence to work towards a mutually acceptable outcome. The session will commence with a brief separate session to confirm any recent developments since the intake, and then confirm the procedure that will be followed, and to allow each party to state what their goal is for the FDR session. An agenda is agreed upon, and each item is explored. This facilitates an understanding of what is important to take into account when considering each item, and perhaps suggesting ideas for outcomes. A separate session is then undertaken with each party, to discuss possible solutions and prepare for the joint negotiation session. These sessions may be conducted together in the same room, or where appropriate, in separate rooms. This is the groundwork for progression towards consideration of what each of the options would look like in practice, and compromise to result in an agreement that both parties could live with!

Within this broad outline, the individual needs of the parties are accommodated, to ensure that the process respects the unique characteristics of each family. The aim is to work together for a tailored solution to reflect these particular aspects.

Conflict coaching session

This is a one on one session with me to prepare for the settlement conference. It involves an exploration of what the conflict mean to each party, what triggers it, and the development of strategies to manage the conflict better.

Child enhanced session

This is a session with a Child Consultant who specializes in understanding the impacts of separation on children and is well versed in recent research regarding child development and age appropriate options. The aim of this session is to facilitate a child focused approach to ensure that the types of options discussed are likely to be in the best interests of the child, and that the needs of the children are not overlooked when discussing the parents needs.

Child inclusive session

This is a session where an experienced and qualified Child Psychologist or similar expert interviews the child to ascertain if they wish to have a voice in this process. The expert provides feedback to the parents directly, and prepares a brief report for the benefit of the lawyers, and myself, to be used in the settlement conference which would follow this session at a later time.

Review session

This is an opportunity to return to FDR at an agreed time to assess the success of a trial regime, and con sider whether it continues to meet the best interests of the child, or should be modified for improvement.
